What is the California Public Records Act?
In 1968, the California Legislature enacted the California Public Records Act (CPRA) under Government Code (GC) sections 6250-6270. In its findings and declarations, mindful of the right of individuals' privacy, the Legislature declared it was the publics’ right to access information concerning the peoples’ business.
 
What is a Public Record?
As defined in the Public Records Act, GC 6252 "public records include any writing containing information relating to the conduct of the public's business prepared, owned, used or retained by any state or local agency regardless of physical form or characteristics."
 
Police Reports
Based on this definition, the report of crimes and incidents written in the course of business of a law enforcement agency are public records and subject to release under CPRA with some exemptions.
 
Who can initiate a Public Records request?
Any person can make a Public Records request. However public disclosure is regulated by several different statutes dependent upon on the record. Such resources are Government Code 6250 et .seq. and 34090.6, Welfare and Institutions Code 827, California Vehicle Code 20012, Penal Code 841.5, 293, 11167.5 and 13300.
 

What types of records are available?
The law requires law enforcement agencies to provide information the public has the right to know and at the same time, to withhold information if the release would jeopardize an individual's right to privacy.

All agency records not exempted by statutory of case law are available. Certain records or portions of records are subject to privacy laws and/or other exemptions and are rarely ever available for viewing. Common public records requests are for:

  • Arrest logs
  • Calls for service logs
  • Statistics
  • Crime reports
  • Accident reports
It is the responsibility of the law enforcement agencies to allow the public access to certain information obtained during the normal course of daily business.

Law Enforcement personnel must be aware of and apply the legal exemptions to the release of some information to protect individual privacy, safety and reputation.
 

Government Code 6254 and Exemptions
GC 6254 specifies exemptions in order to balance the individual's right to privacy with the public's need for information. Items that will most likely be redacted from Rialto Police Department public records are:

  • Identifying juvenile information
  • Identifying victim information associated with crimes to Penal Code Sections 261,264,264.1,273a,273d,286,288 or 289
  • Identifying confidential informant information
  • Criminal offender record information
  • Information that may endanger the safety of a witness or the other person
  • Information that may jeopardize an investigation, related investigation or law enforcement proceeding
  • Any portion of the report that reflects analysis, recommendation or conclusion of the investigating officer
  • Information that may disclose investigative techniques
  • Information that may deprive a person of a fair trial
  • Preliminary drafts, notes, or memorandums which are not retained in the ordinary course of business
  • Records pertaining to pending litigation to which the city is a party until the litigation is adjudicated or settled
  • Personnel, medical or similar files
 

How to make a Public Records Act Request
A public records request for information from the Rialto Police Department can be started by contacting the Rialto Police Department. You will want to include the following information to ensure the scope of the request is understood and clear enough for personnel to determine if we have the records you are requesting.

  • The date(s) of the record
  • The subject of the record
  • A clear and specific description of the record
  • Any additional information that helps staff identify the record
  • Your complete contact information, so that we may notify you when your request is available
Prompt access to public records is required by the CPRA (Government Code 6253). The 10– day period mentioned in the act is not a legal deadline for producing records. The 10-days allows the agency to review records, if it is not clear that they are public records. As soon as a determination is made, it will be at that time the records shall be released.

The rights under the CPRA provide for the inspection of public records or to obtain copies of identifiable records, it does not compel the agency to create lists or reports in response to the request.

Under Government Code 6253(b), Agencies may charge for the "direct costs" for providing copies of an identifiable record.

KASSAI SELLASSIE LEWIS

Age at Death: 26 years

Synopsis: On March 30, 2012 at approximately 12:44 a.m., officers responded to a call of a single vehicle traffic collision at the corner of Riverside Avenue and South Street in Rialto. Upon arrival officers located the body of Kassai Lewis inside the vehicle with obvious signs of trauma. Lewis was transported to a hospital where he was later pronounced dead. It was determined that Lewis had been shot sometime prior to the collision.

JOSE FRANCISCO TRIVIS

Synopsis: On May 7, 2011, a decomposing body was discovered in a vacant field in the City of Rialto. The victim was confirmed as having been a victim of homicide. DNA from the victim identified him to be Jose Francisco Trivis from San Bernardino.

Synopsis: On August 27, 2010 at approximately 2327 hrs, officers responded to a call of shots fired and a subject down in the east alley of 1400 N. Clifford Ave, Rialto. Upon arrival they located the body of William Nunnery.

Synopsis: On June 7, 2009 at approximately 2340 hrs, officers responded to a call of shots fired and a subject down at 1621 W Rialto Ave, Rialto. Upon arrival they located the body of Keyon Andre Fowler.

Synopsis: On December 05, 2008, Douglas Berry was sitting in front of a friend’s apartment in the area of the 1400 block of north Clifford, Rialto.  An unknown suspect approached and shot at Berry, killing him.

Synopsis: On July 18, 2008 at approximately 1215 hrs, officers responded to a call of shots fired and a subject down in an open field at Foothill and Larch, Rialto. Upon arrival officers located the body of Hector Manuel Sandoval.

Age at Death: 30 years

Synopsis: On June 29, 2008 at approximately 0551 hrs, officers responded to Arrowhead Regional Medical Center (ARMC) in reference to a victim that had earlier been brought into the emergency room after being beaten. The victim was later pronounced dead at the hospital. It was determined that the incident originally occurred in front of 691 S Date St., Rialto.

SIDNEY RAY HAWKINS

Synopsis: On May 31, 2008 at approximately 1049 hrs, officers responded to a call of shots fired and a subject down in a vehicle at Foothill//Cedar, Rialto.  Upon arrival officers located the body of Sidney Ray Hawkins.  Hawkins was transported to the hospital by paramedics where he was later pronounced dead.

Upon arrival officers located the body of Fred Navarro. Navarro was transported to Arrowhead Regional Medical Center (ARMC) where he was pronounced dead.

Amezola was in the drive thru waiting to purchase food when someone from another vehicle began shooting at the victim. Upon arrival, officers located the body of Robert Amezola, Jr. He was transported to Arrowhead Regional Medical Center (ARMC) where he was pronounced dead.

Upon arrival officers located the body of Shawnta McClendon. McClendon was transported to Arrowhead Regional Medical Center (ARMC) where he was pronounced dead.

Synopsis: On September 19, 2004 at approximately 0348 hrs, officers responded to a call of a subject down in front of 911 S Cactus Ave.  Upon arrival officers located the body of Danny Bell who had obvious signs of trauma to his body.  Bell was pronounced dead at the scene.  It was determined that Bell had been stabbed to death.

Synopsis: On August 3, 2004 at approximately 1523 hours, officers responded to a call of a fight with shots fired and a subject down at 200 E. Jackson St., Rialto. Upon arrival officers located the body of Shaylen Martin. Martin was pronounced dead at the scene. Witness observed the suspect fleeing the scene in a vehicle.

Synopsis: On July 9, 2004 at approximately 2048 hrs, officers responded to a call of shots fired and a vehicle crash at Sycamore//Jackson St, Rialto. Upon arrival officers located the bodies of Kobby Akushie and Roderick Scott still inside their crashed vehicle. Both victims died as a result of gunshot wounds. It was determined that both victims had been shot while in the north alley of 200 E Jackson St.

 JERRY TREADWAY

Sex: Male

 

Synopsis: On June 28, 2004, Jerry Treadway was in the area of the 300 block of West Winchester, Rialto. He attempted to break-up a fight between his friends and a group of hardcore gang members. For his efforts, Treadway was shot and killed.

CORNELIUS CRAYTON

Sex: Male

 

Age at Death: 38 years

 

Synopsis: On August 31, 2003 at approximately 3:00 am, Cornelius Crayton and a female acquaintance arrived at 111 S Maple Avenue, Rialto.  They parked and sat in their vehicle.  Two unknown suspects approached Crayton and shot him multiple times.  Crayton died a short time later.

EUGENE MICHAEL SCHEFTNER, JR. 

Race: White

 

Sex: Male

 

Age at Death: 50 years

 

Synopsis: On May 21, 2003 at approximately 0200 hrs, officers responded to a call of a Vehicle vs. pedestrian collision at Foothill Blvd. and Acacia Ave, Rialto.  Upon arrival officers located the body of Eugene Scheftner on the ground in the middle of Foothill Blvd.  Scheftner was pronounced dead at the scene.  The investigation led to information which indicated that Scheftner was beaten and left in the street unresponsive before being run over by an unrelated party.

Synopsis: On April 26, 2003 at approximately 1056 hrs, officers responded to a call of shots fired and a subject down at 300 W Ramona Dr, Rialto. Upon arrival officers located the body of Kenneth Nash on the ground outside a vehicle parked on the street. Nash was pronounced dead at the scene.

 REBECCA SIMON

Sex: Female

 

Age at Death: 18 years

 

Synopsis: On November 4, 2002, at approximately 1730 hours, Rebecca left her house en-route to the grocery store. She was never seen alive again. The next day her body was discovered dumped in a vacant field. It appeared she had been brutally beaten and murdered at another, unknown location. Rebecca left behind a two year old daughter and a loving family.

Synopsis: On September 1, 2002, Jorge Menjivar was shot and killed in the area of the 1400 block of North Millard, Rialto, following a verbal dispute.

Synopsis: On April 6, 2002, Karina Sandoval was shot and killed following an argument outside of a Rialto bar located at 655 S. Riverside Avenue. The suspects fled the scene in a newer modle pickup truck.

FRANK SLAMEN, JR.

Synopsis: On January 20, 2002, Frank Slamen, Jr. was discovered dead inside his residence. He had been beaten and strangled to death.

Synopsis: On January 18, 2001 at approximately 1145 hours, Kenneth Liedle was discovered deceased inside his semi-truck as a result of a gunshot wound. He was parked at the I-10 Truck Stop located at 195 E. Valley Blvd., Rialto.

RANDALL CAZIER

Sex: Male

 

Age at Death: 38 years

 

Synopsis: On June 28, 2000 in the early morning hours, Randall Cazier and a female acquaintance were walking in the parking lot of 1610 S. Riverside Avenue, Rialto. The two were approached by two black male suspects. A physical altercation ensured between Cazier and the suspects. The suspects then entered a vehicle and fled the area. A composite drawing of both suspects was created utilizing the help of eyewitness to the murder.

BRANDON CARL KELSO

Age at Death: 21 years

 

Synopsis: On July 23, 1998 at approximately 0900 hours, Brandon Kelso’s body was discovered in Lilac Park. He was stabbed and beaten to death. Two Hispanic males were identified as being the last persons to have contact with Kelso at a convenience store near the park.

Synopsis: On March 9, 1994 at approximately 0033 hours, officers responded to a call of shots fired and a subject down in the laundry room at 200 W. Jackson St. Upon arrival, officers located the body of Travon Smith. He was transported to San Bernardino County Hospital where he was pronounced dead.

In March, 2013, the Rialto Police Department established its first ever Cold Case Homicide Unit.  The Cold Case Homicide Unit is based out of the Investigations Unit and is dedicated to the thorough investigation and pursuit of every unresolved homicide that occurred in the City of Rialto.  Our mission is to give a voice to those who can no longer speak for themselves.  Our ultimate goal is to give answers and a sense of closure to the loved ones of every murder victim.

Cold case homicides are homicides that have been reported and investigated but lacked resolution.  A homicide becomes “cold” as a result of various factors.  This site will profile as many of these cold cases as possible.
